A £50,000 credit hire claim has been dismissed by the court following an October 2015 incident where a motorcycle was allegedly damaged by a valet driving a Citroen.
The claimant initially sued the Citroen’s owner but failed and later pursued Hastings Direct, the insurer, which denied liability. After nearly ten years, Hastings Direct and legal advisors HF successfully defended the case.
The judge found the engineer’s report unreliable, noting it did not comply with Civil Procedure Rules and lacked evidence of an actual inspection. Kay Denyer of Hastings Direct highlighted the case as an example of their fight against fraudulent claims. Graeme Mulvoy of HF criticized the practice of declaring minor damage as unroadworthy.
The judge’s decision hinged on the report’s inadequacies, leading to the claimant’s inability to prove damage or repair costs, resulting in the dismissal of the claim.
